Website Ownership and Content
The Website contains materials including, but not limited to, text, images, designs, photographs, videos, audio clips, graphics, button icons, pictures, advertising copy, URLs, technology, software, and the overall arrangement or “look and feel” of such materials including copyrightable material, as well as trademarks, logos, and service marks that belong to either artdesign88, its licensors, licensees or other third parties (collectively the “Content”).
artdesign88 is the operator of the website and a sub-brand of label88 published on artdesign88.org, net, com and it`s subsites (the "Website"). This Agreement governs your use of the Site and your donation or payment of products from "artdesign88" (the "Products"). The Site and Products are offered subject to your acceptance of these Terms and Conditions ("Terms" or "Agreement"). These Terms constitute a legally binding agreement between you and artdesign88. By agreeing to these Terms, you also agree to artdesign88's Privacy Policy, Online Returns Policy, Store Returns Policy, and Shipping Policy, each of which is expressly incorporated herein by reference.
Prints, maps, 3D models or other content created to order are not permitted for resale without our written consent. For resale send us an inquiry!
Books are subject to International Guidelines and may not be reproduced without permission.

Services
For the most part, we offer free services. All free services that we provide to you are not free of charge for us. It takes a lot of time and money to provide them for you. Nevertheless, we do not use marketing addons and the like to improve our budget. Our motto is: to offer quality in an increasingly quality-less world and to satisfy our visitors. You use our services as offered and there are no obligations on our part to provide them 24/7. Our infrastructure is high-performance and can still be subject to a failure. Be it for maintenance or other reasons. Users of our services are not entitled to compensation at any time. E-mail inboxes of our customers are also subject to the duty of care of the respective owner, not artdesign88.
The same applies to all other content through our systems. Which the user publishes on these, makes available for download or links.

Book cover and artwork made from customer requests
Orders and requests for book cover and artwork must be described in detail by the purchaser so that the amount and the service or time expenditure remain within reasonable limits. artdesign88 makes a maximum of two improvements to one order. Donations must be made before the final product is handed over. All partial products, designs, etc. received by the customer from artdesign88 are to be removed from all of the customer's devices and are subject to our rules on copying rights.
artdesign88 acts as the designer for the book cover and artwork. artdesign88 creates book covers on a donation basis. Donations are non-refundable, as each book cover and artwork made to order, explicitly for the respective author. All costs incurred by artdesign88 for unlawful handling by the Client, plus interest and an expense allowance in the amount of the donation contribution of the respective book cover or artwork, must be paid by the Client to artdesign88 within a period of 4 weeks after a chargeback by the Client.

Newsletter
We provide a free newsletter system for our authors and artists.
Subscibers can subscribe to use any newsletter, just accept the terms and condition and to tick the checkboxes.
Newsletters can be unsubscribed at any time via the link provided for this purpose and your profile.
Through our newsletter system, it is easy to send newsletters in different languages to subscribers. In order to benefit from your own newsletter provision via artdesign88, you do not have to do anything more than publish at least one book via our website or have a book cover created by artdesign88. All information received via the newsletter system is stored professionally and is assigned to the respective owner of the newsletter. We do not store any further data within the newsletter system. We only store entered personal data for as long as the owner wishes. With the termination of a newsletter and a "request to delete your personal data", we will comply with your request within the deadlines.
Depending on which newsletter you register for, our newsletter system will send you information. Authors and artists are responsible for their own newsletters and their content and never artdesign88.

Other Services for Authors and Artists. 
In addition to the newsletter, we provide other services. These services, whether free or paid, are to be maintained by the respective user without exception according to the rules of artdesign88. It is not allowed to advertise for third parties or to make sales outside of our website or shop for products that the user has published on artdesign88.

Users of our free services
- As a user of our services, you agree to advertise artdesign88. Since almost all services are free of charge for you, this is the only way to show your appreciation. - In order to prevent spam, every user of artdesign88 services is obliged to publish his/her books or works on artdesign88's websites for at least 1 year. The quality of the published works, in the case of books the cover is specified by artdesign88. No 1:1 copies may be included in a cover or work. With the help of AI-generated content, we refuse! We remove such content from our websites.
- Authors and artists who wish to have their works removed from artdesign88's websites before the end of the one-year period will pay a lump sum of 500 dollars / euros as an expense allowance. We offer a variety of free services, for the maintenance and installation of which a considerable effort is made by artdesign88. This is done by artdesign88 for free. - All users are responsible for providing correct information, this cannot be transferred to artdesign88. This applies in particular to the website and profiles provided via our services.

Donation and Payment
Before you can download  any content or we deliver goods, you need to donate or pay for it. Expect free declared content.
You can donate and pay over the following ways:
PayPal, Bank Transfer (IBAN and SEPA), Western Union for loyal customer.
Donation and payment over PayPal is simple. Like any other money transfer just put the goods in your basket and go to checkout.
All items from artdesign88 are available for a donation only. Payment options from authors and artists, are at the discretion of individual authors and artists.

The concept for donations developed by @artdesign88
artdsign88 pursues public and charitable purposes. We provide online services free of charge to promote culture, art and creativity. Not least to protect certain groups of people and people's privacy.

Books, works of art and all contents in the "basket" of artdesign88 (artdesign88.org/basket), if they are articles of artdesign88, are created for an expense donation or for a donation in kind. Since we have costs for the provision and maintenance of the services and platforms offered free of charge, we rely on donations. For this reason, we ask every customer to send us a certain amount of donation. People who purchase items with a donation do so voluntarily and for the sake of it! By adding an item to the shopping cart that is accompanied by a donation amount, completing the further process to receive the item, any compensation as an expense donation or donation in kind will be accepted by all parties and will be considered and considered absolutely voluntary.

Authors and artists can decide for themselves how they want to handle this for their articles. artdesign88 is not responsible for the management or correct billing of the individual author or artist between their clients. artdesign88 only provides a free platform on which users can present their articles. 
As an author or artist, you have the following options to have your articles remunerated: 
- Sale with invoice (is the responsibility of the respective author and artist) 
- For a donation (expense donation).

This is where the remuneration concept developed by artdesign88 comes into play. How does it work? If you would like to have one or all of your items remunerated with a donation, please send us a corresponding link. Example: With PayPal you have the possibility to generate ›donation buttons‹. You can generate a link for each of these buttons. We can use this link to let customers and interested parties pay for your articles. Since artdesign88 pursues non-profit and charitable purposes, donations are important so that you can continue to use free services of artdesign88 in the future.

1a. For every link to a donation account that we manage for you, we maintain a credit account. 
1b. If one of your items is sold, we will deduct the 10% expense donation from this amount. As soon as your balance in one of your donation accounts falls below a certain amount, top it up again.
1c. Topping up your credit is a normal transfer to one of our donation accounts. For each donation account that we manage for you, you will receive an overview in which you can see what artdesign88 debits from it and for which article.

For example: 
You are an author or artist, have generated a donate button and would like to set up a donation account with us to sell your items. 
1. You send us the link to your donation account at PayPal or wherever you have this donation account. 
2. artdesign88 creates a separate account for each link (locally at artdesign88). This is where we record your donations and sales. 
3. You top up your donation account at artdesign88 with a voluntary amount. You can customize it later on. Depending on how many donations you can make yourself. 
4. Since the customer receives the corresponding link to your donation account when donating one of your items, you will receive the entire donation amount directly, not artdesign88!
5a. As soon as you have received the donation amount, notify artdesign88 and let them know which item may be released for download. 
5b. artdesign88 will then reduce the amount in your donation account (at artdesign88) by the voluntary donation of 10% of the corresponding item that you have voluntarily granted. 
6. artdesign88 will release the respective item to the relevant customer as requested by you. 
7. The customer will automatically receive a notification that the item is available for download. 
8. The customer can download the item.

This concept has several advantages! 
1. There are no discrepancies between artdesign88 and you regarding settlements. 
2. You will receive the amount directly from the customer to your donation account, not artdesign88. 
3. You always have an overview of statements about expense donations/donations in kind at artdesign88. We will send them to you monthly. 
4. Donations are tax deductible in many countries. This gives many customers the opportunity to deduct their donations from their taxes. 
5. You will receive compensation for your items much faster this way than elsewhere. 

The whole process is much simpler than it seems at first glance. If you need support in generating a donation account or donation buttons, we will be happy to help you.

Bank Transfer
We prefer to pay by simple bank transfer with IBAN number or SEPA as it is the safest.

PayPal
A donation or payment via PayPal is also possible or even easier than a bank transfer. It's a quick process and easy to handle. We will send you the link to the donation page.

Western Union 
Donation or payment over Western Union is only possible for loyal customers and for payments over 50 Dollars or Euros.

User Obligations
By downloading, accessing or using the Site, you represent that you are at least eighteen (18) years of age or the age of majority, whichever is greater, and that you agree to these Terms. You also agree to comply with all applicable local, state and national laws and regulations regarding your use of the Site. You further warrant that you will provide true, accurate, current and complete information (and updates thereof) at all times when submitting information to artdesign88 through the Site. You may use the Site only under this Agreement, and you may not use the Site or Content for any commercial, political, obscene, illegal or inappropriate purpose.

artdesign88 reserves the right, in its sole discretion, to terminate your access to the Website for any or no reason. If you register for an account on the Website, you may be required to designate an email address and password, and there may be additional requirements as designated by artdesign88 from time to time. You agree to assume all responsibility concerning your use of the Website, including all activity occurring through your password (and related account access). You shall immediately notify e88 BookStore if you suspect or become aware of any loss, theft, or unauthorized use of your password. 

Purchases through the Website
All purchases made through the Website are subject to our acceptance. This means that we may refuse to accept or may cancel any transaction, in our sole discretion, and without liability to you or any third party. The Website does not permit orders from dealers, wholesalers, or other customers who intend to resell items offered on the Website.
artdesign88 expressly conditions its acceptance of your order on your agreement to these Terms, and to all additional terms and conditions that are provided to you on the Website that govern your purchase of certain Products. By ordering Products through the Website, you agree to provide true, accurate, current, and complete information. artdesign88 reserves the right without prior notice to discontinue or change specifications and prices on Products offered on and outside of the site without incurring any obligation to you. Prices and availability are subject to change without prior notice, and artdesign88 reserves the right to revoke any offer to correct any errors, inaccuracies, or omissions.

User-Generated content
The contents and works created by the site operator on these pages are subject to copyright.
By submitting or posting any materials or content on the Site ("User Generated Content"), you grant artdesign88 a perpetual, irrevocable, royalty-free, worldwide, sublicensable and transferable license to copy, publish, translate, modify, reform, create derivative works from, distribute, reproduce and sublicense such materials or any portion thereof. You hereby represent, warrant and undertake that the User Generated Content you provide will not violate any law or the rights of any third party, and you have the unrestricted right to grant artdesign88 the above license. artdesign88 may use User-Generated Content without any confidentiality, attribution or compensation obligations to you. Duplication, processing, distribution and any kind of exploitation outside the limits of copyright require the written consent of artdesign88 (label88). In particular, third-party content is marked as such. Should you nevertheless become aware of a copyright infringement, please let us know. Upon notification of legal violations, we will remove such content immediately. The donor of any content is entitled to copy the purchased goods for personal use. A resale of the goods with profit intentions is not permitted. The reproduction rights are not transferable to third parties.

Authors and Arists payoffs
Authors who publish their books and artists their artwork with artdesign88 benefit from the following advantages, and are subject to the following rules: 
- Publishing books and artwork is free.
- Payouts of paid income are remunerated at 90% of the net price.
- The payday is always on the following Monday after the invoice for the corresponding goods has been settled. The amount to be paid must exceed 50 dollars or euros. Transfer and transaction fees are to be paid by the respective author or artist.
- Discounted services (book presentation service, book cover generation, etc.) 
- Books published by third parties may be subject to certain rules. The respective author is responsible for compliance with these rules and can never be transferred to artdesign88. 
- Artists and authors are solely responsible for the content of their goods. artdesign88 it is not possible to review all books, fonts, paper works, etc. to read through or understand, it should be also in another language.

Fixed book prices
Authors are responsible for compliance with the statutory fixed book price, should these be applied. In the event of a discrepancy in a book price, artdesign88 must be informed so that the price can be corrected.

IMPORTANT: The Content and information in this document and our Website is confidential, protected by federal copyright law. Sharing it with anyone, without written permission by the copyright owner (artdesign88 (label88)), is an infringement of the copyright owner's exclusive rights of reproduction and/or distribution. Anyone found to have infringed a copyrighted work may be liable for attorney's fees incurred by the copyright owner to enforce his or her rights, plus statutory damages up to $20,000 for each item infringed and, in cases of willful infringement, that amount may be increased up to $200,000 for each item infringed.
